Terms of Service

1. Acceptance of Terms

By submitting an application or participating in The Nextist 30-Day Executive Sprint (“the Program”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not participate in the Program.

2. Description of Services

The Nextist provides a private, high-touch 30-day execution program for a limited number of high-performing founders, investors, and operators. The Program includes a baseline diagnostic call, daily or every-other-day voice-note guidance, weekly group Zoom sessions (maximum 5 participants), access to the Premium Audio Feed during the Sprint, and a personalized 30-day execution matrix.

3. Eligibility and Selection

Participation is limited to five (5) men per month. Ken Rutkowski personally reviews every application. Submission of an application does not guarantee acceptance. We reserve the right to decline any application at our sole discretion.

4. Fees and Payment

The fee for the Program is $3,997. Payment is due upon acceptance into the Program. All fees are non-refundable except as provided in the 14-Day Alignment Guarantee below.

5. 14-Day Alignment Guarantee

We offer a 14-Day Alignment Guarantee. If you reach Day 14 of the Program and genuinely believe the insights and approach do not align with your execution needs, you may request a full refund of $3,997. To qualify, you must notify us in writing by the end of Day 14 and have participated in the required activities up to that point. Refunds will be issued within 14 business days. After Day 14, no refunds will be provided under any circumstances.

6. Participant Responsibilities

You agree to:

• Show up for all scheduled calls and group sessions.
• Complete voice-note assignments and check-ins in a timely manner.
• Be honest and open during the process.
• Maintain confidentiality regarding other participants and all materials shared in the Program.

7. Intellectual Property

All materials, frameworks, voice notes, recordings, and the personalized execution matrix provided during the Program are the intellectual property of The Nextist and Ken Rutkowski. You may keep and use your personalized execution matrix for your own purposes. You may not copy, distribute, or resell any Program materials without written permission.

8. Confidentiality

We treat all information you share during the Program as confidential. You agree to treat information shared by other participants and all Program content as confidential. This obligation continues after the Program ends.

9. Limitation of Liability

The Nextist and Ken Rutkowski provide coaching and strategic guidance only. We are not responsible for any business, financial, health, or personal outcomes resulting from your participation. The Program is not a substitute for professional legal, financial, medical, or mental health advice. Our total liability shall not exceed the amount you paid for the Program.

10. Termination

We reserve the right to remove any participant from the Program for violation of these Terms, disruptive behavior, or failure to engage in good faith. No refund will be issued in such cases.

11. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.
